LICENCE:

For the use of a single article (Article) purchased using the eCart facility for the International Journal of Equity and Innovation in Early Childhood (Publication)  

Parties

The University of Melbourne (University) and the purchaser of the Article (You)

Licence

1.  In consideration of payment of the relevant fee for the Article as set out on the Publication website (Fee), the University will provide the Article to You and grants You a non-exclusive, non-transferable, revocable licence to retain, use and communicate the Article strictly in accordance with the terms contained in this document (Licence).

2.  The Article will be provided to You in electronic form. 

3.  The Article is for your personal use only, and you may only download and print the Article for your personal use.

4.  The Licence commences upon Your receipt of the electronic reproduction of the Article.

Obligations and Restrictions

5.  You must not reproduce or communicate the electronic reproduction of the Article in any form or by using any other media to any other person whatsoever.

6.  Except as expressly provided for under this Agreement, You must not:

a.  make the Article available on the internet or transmit it via email or any other electronic means to any person;

b.  modify, translate or create any derivative works based on the Article; or

c.  assign, transfer or licence any of Your rights or obligations under this Licence unless You obtain the prior written approval of the University.

7.  You must ensure that the Article is not subjected to any treatment which:

a.  is prejudicial to the honour or reputation of the author/s of the Article, or

b.  infringes the moral rights of the author.

8.  You acknowledge that the Licence does not make You the owner of the Article nor does it cause any transfer or assignment of any copyright or other intellectual property rights subsisting in the Article to You nor to any other party. This clause will survive the termination of this Agreement.

No Liability

9.  The University makes no warranty in relation to the Article’s accuracy or fitness for any purpose.

10.  Your use of the Article is at Your own risk.  To the full extent permitted by law, the University is not liable for any claim, loss, liability, expense, damages or costs made against or incurred or suffered by You arising directly or indirectly in connection with Your use of the Article.

11.  Where legislation implies in this Licence any condition or warranty, and that legislation prohibits the exclusion of that condition or warranty, the liability of the University for a breach of that condition or warranty will be limited to the maximum extent possible, and at the option of the University will be limited to the replacement of the Article.

12.  You indemnify the University against all loss, liability, expenses, damages and costs arising out of or in connection with any claim by a third party relating to a breach of this Licence, or any use of the Article by You.

Termination

13.  This Licence continues indefinitely unless terminated in accordance with clause 14.

14.  This Licence may be terminated immediately by the University if You are in breach of any of the terms of this Licence. Upon termination, You must immediately cease to use the Article in any manner whatsoever.

15.  Upon request by the University, You must return any and all copies of the Article in Your possession, custody or control to the University if the Licence is terminated in accordance with clause 13.

General

16.  You may not assign this Agreement or any part of it without the prior written consent of the University.

17.  These terms constitute the entire agreement between the parties in relation to the Article.  This Licence may on be varied in writing by mutual agreement of the parties.

18.  This Licence will be governed by the laws in force in the state of Victoria and the parties submit to the jurisdiction of that State.
